The never-ending legal drama between Blake Lively and Justin Baldoni took a huge turn yesterday, and now, both sides are being pushed toward settlement talks.
After months of back-and-forth, a federal judge dismissed the majority of Lively’s claims tied to It Ends With Us, including her sexual harassment allegations.
That ruling dramatically shifted the weight of the case overnight. While three claims, breach of contract, retaliation, and aiding and abetting retaliation, are still heading to trial, the dismissal of the more serious accusations changes the leverage on both sides.
Now, according to DailyMail, lawyers for both parties have been ordered to speak separately with U.S. Magistrate Judge Sarah Cave to discuss their “updated settlement position.” Which means the court is testing whether this can be resolved before things escalate further in a courtroom.
There will be two calls on Monday, according to the outlet, and the public will not have access to what was said during the call. The last time they met to talk about a settlement, things were unsuccessful, despite them showing up in matching looks.
What each side is saying
Following last night’s dismissals, Lively’s attorney, Michael Gottlieb, insisted that she’s preparing for trial next month, emphasizing that the dismissal came down to legal technicalities – not a validation of Baldoni’s behavior. “The court held that Ms. Lively’s sexual harassment claims could not go to a jury because Ms. Lively did not sign a contract, that she is an independent contractor instead of an employee, and that the offensive conduct occurred in New Jersey instead of California,” he said.
On the other side, Baldoni’s lawyer Bryan Freedman is calling the ruling a major win, doubling down on their stance that the claims were unfounded from the start. Freedman celerbated, telling TMZ, “The truth has prevailed. It is gratifying to see that the court’s ruling confirms what the legal team believed from day one.” “The defendants were not afraid of the truth. The plan was not only to speak the truth but also to show that same truth over and over again through the presentation of actual evidence. Neither Justin Baldoni, [It Ends With Us lead producer] Jamey Heath, nor any of the other defendants have engaged in the sexual harassment of Blake Lively,” he continued.
Why a settlement makes sense right now
Even with a trial date looming, this is the exact moment cases often pivot toward settlement. One major reason is the risk on both sides. Lively still has claims moving forward, and a judge noted there’s “some direct evidence” tied to alleged retaliation. That alone keeps pressure on Baldoni’s camp.
Then there’s the public narrative. This case has already played out heavily in the media. A trial would only amplify that, for both of them. A-list celebrities have already been dragged into the mix, with their texts fully available to the public, and Lively may have lost her best friend, Taylor Swift, as a result.
Then there’s the risk of an uncertain jury. With conflicting accounts about whether backlash against Lively was organic or orchestrated, a jury could go either way, a risk neither of the teams may want to take.
