Taylor Swift and Travis Kelce may have only just said “I do”, but legal experts are already weighing in on what their reported prenuptial agreement could look like – including one surprising clause that could protect more than just their fortunes.
The superstar couple tied the knot in front of around 1,000 guests at New York City’s Madison Square Garden on Friday, bringing together Hollywood, music and sporting royalty for one of the biggest celebrity weddings in recent memory.
Now, divorce attorneys believe the newlyweds’ reported prenup is likely to be as carefully considered as their multi-million-dollar careers.
Keeping their fortunes separate
Neither Taylor nor Travis has publicly confirmed the existence or details of a prenuptial agreement.
However, Manhattan divorce attorney Jacqueline Newman believes any agreement would likely be relatively straightforward given the enormous wealth each brought into the marriage.
“I think the prenup is actually going to be a pretty simple document – what’s his right now will be his and what’s hers is hers,” she told the Daily Mail.
© GC ImagesShe explained that any major purchases made together during the marriage, such as property, would likely be divided according to each person’s financial contribution.
“If they put money into a joint asset using joint names, like a home, they’d both get back what they put in plus any appreciation,” she said.
Taylor’s music empire
Experts also believe Taylor’s hugely successful business empire would remain firmly under her ownership.
The Grammy-winning singer has built one of the most valuable catalogues in music, while her income from touring, streaming, merchandise, films and endorsements has propelled her into billionaire status.
© Taylor Swift“My guess is not,” Newman said when asked whether Travis would receive a share of Taylor’s future earnings.
“Unless they decide to do something together in some capacity.”
She added: “She values her output greatly, and I believe there will be a very clear document that says what she creates in the future is hers. Similarly, he’s got creative things that he would obviously want to retain. I believe they will be very respectful.”
The clause everyone is talking about
© InstagramWhile financial protections are common in celebrity prenuptial agreements, Newman suggested there could be another provision attracting even more attention.
The attorney believes the document could potentially include confidentiality language relating to Taylor’s songwriting.
“Potentially there could be something in a prenup that would hamper her doing similar because it’s kind of her signature,” she said, referring to the singer’s long history of writing songs inspired by past relationships.
According to Newman, legal agreements can include confidentiality clauses that extend beyond financial matters.

“There can definitely be language to make attempts to try to avoid her being able to do that,” she explained, while acknowledging that creative expression can be difficult to regulate and enforce.
“There are ways you can get round it with creative licence, because you can only draft so much and everyone’s probably going to know what she’s talking about, even if it is described very differently.”
A straightforward agreement?
Florida-based prenuptial attorney Brian Karpf agreed that, because both Taylor and Travis entered the marriage with significant independent wealth, dividing their assets would likely be relatively uncomplicated.
“This is pretty straightforward in light of their respective wealth. It makes things simpler,” he said.
© Getty Images“Perhaps they do some joint ventures, but I would suspect most of their estates would remain separate. I believe all her future earnings are going to remain her separate property. That is likely to be carved out at this point.”
Karpf also suggested that any confidentiality provisions could discourage either party from publicly discussing intimate details of the relationship should it ever end.
“Maybe they could have some language that talks about not getting into intimate details,” he said. “It’s possible, but it’s hard to police.”
